Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial, use is prohibited without the permission from Eauk or AaimB.V. We are based in the Netherlands. For all statutory foreign based organizations or their representatives in the Netherlands. Any content, trademarks, or other material that might be found on this website that is not the property of Eauk, remains the copyright of its respective owners. LIMITATION OF LIABILITY EAUK
Eauk shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Eauk has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

TYPOGRAPHICAL ERRORS
In the event that an Eauk product is mistakenly listed at an incorrect price, Eauk reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Eauk reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your payment is charged. If payment has already been charged for the purchase and your order is cancelled, Eauk shall issue a credit to your bank, PayPal or credit card account in the amount of the incorrect price.

TERM TERMINATION
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Eauk without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Eauk its officers, directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

THIRD-PARTY LINKS
In our attempt to provide increased value to our visitors, Eauk may link to sites operated by third parties. However, even if the third party is affiliated with Eauk, Eauk has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Eauk. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, Eauk seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).

ALLERGY
If you tend to have skin allergies, or are allergic to perfumes, don’t buy Eauk. Furthermore, take in mind that perfumes may cause skin allergy when used in combination with the sun. We take no responsibility or liability for a possible allergic reaction because of using/wearing Eauk perfume purchased from this site. We took great care to only use ingredients that are conforming to the standards of the perfume industry.

LIABILITY
When selling online, the seller is only bound by a limited duty; its liability may not be sought for damages resulting from the use of Internet such as the loss of data, any intrusion, virus, service disruption or other non-voluntary issues.

• Eauk reserves the right, in its absolute discretion, to take any of the following measures if you fail to make a payment in accordance with these Terms of Trade:
  • withhold supply and dispose of the Products requested in the order, and/or;
  • refuse to deal further with you, and Eauk will not be liable to you for any loss or damage directly or indirectly resulting from any such action.
• You have sole responsibility for determining the suitability of the Products for the purposes for which you intend to use them.
• Subject to the following “Warranty” clause and to the fullest extent permitted by law, the liability of Eauk for any loss or damage suffered by you as a result of Eauk breaching its obligations under these Terms of Trade or other tortious duty (including arising by reason of defects in the Products) is limited to a refund or replacement of the relevant Products.

DESCRIPTIONS AND PRODUCT INFORMATION
We have made every effort to represent the colors of our products as accurately as possible. However due to differences in monitors we are unable to guarantee that the color you will see on your monitor will reflect the true color of the product. If you have any questions about the product you may of course contact us.
We check and double-check the quality of our products during and after production, as well as before sending it to you. But due to the anodizing process involved in the finishing of some of our products, there possibly could be a very slight variation within the color. Please do mind that the fragrances can have small traces of ingredients in the bottle. There is nothing wrong wit this, it’s just the nature ingredients joining forces. It might therefore be wise to gently shaken the bottle before applying the perfume to your skin.

APPLICABLE LAW
All transactions undertaken through this website are governed by Dutch Law and any legal actions arising out of such transactions shall be subject to the Dutch legal processes and under the jurisdiction of Dutch Courts. In the event of disagreement between Eauk and its clients, which cannot be mutually resolved in a reasonable time, customers are invited to participate in a mediation process to settle the dispute. However, this is not compulsory and does not affect the consumer’s rights to bring legal proceedings against Eauk. If the mediation process is agreed, then either party may ask for the appoint of a mediator to settle any dispute before bringing the matter into the legal process. In this event, both parties agree to be bound by the decisions of such mediator and mediation process.

VIOLATION OF RULES
Eauk reserves the right to seek all remedies available at law and in equity for violations of these Terms and Conditions, including the right to block access to the site. Individuals violating the restriction of password-protected areas of the site may be subject to prosecution.

FORCE MAJEURE
In case of Force Majeure, Eauk obligations are procrastinated. The contract between you and Eauk can in such cases be partially or fully terminated by yourself or by Eauk. A Force Majeure is at the event of war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or Internet service, natural disasters or similar events. Eauk will under such circumstances do all we can to solve the matter for our customers as soon and entirely as possible.

STATEMENT ON THE EAUK STORY
The EAUK story may, to some extent, lead to questions about our perspective on Dutch history. That is regarding the Dutch exploiting people and lands in the former colonies and enslaving people in the age of the VOC. We clearly take distance from these acts and we regret that this happened. Furthermore, in no way are we proud on what can be regarded as negative parts of Dutch history. The EAUK story is not specifically about the VOC age. It is about being adventurous, bold and elegant and focuses on the positive things that happened in the past and the charms of these times. It celebrates the personality of the gentleman adventurer both then and now all over the world.
